The Supremacy Clause of the U.S. Constitution
Although cannabis may be legal in your state, the federal law that classifies cannabis, or "marijuana" as illegal, will almost always trump state law. The Supremacy Clause of the U.S. Constitution provides that federal law will prevail if state or local laws are ever in conflict. Until cannabis is legal on a federal level, we are still subject to federal penalties despite the fact that you may be in lawful possession in your locality.
